Oklahoma car bill of sale Do you need one? And what else does Oklahoma require?

The buyer needs proof of the price. Below: the title signature, the plates, telling the state, and the odometer — each with the source it came from.

Do you need a separate bill of sale?

The buyer needs proof of the price

No bill of sale is needed to make the transfer work — the notarized assignment does that. But the buyer cannot title the vehicle without documenting what they paid, because excise tax is calculated on it. Oklahoma tax law says the price goes on the bill of sale you give the buyer, or on a form Service Oklahoma prescribes. Service Oklahoma accepts a purchase contract, a bill of sale, or Form 722-1 Declaration of Vehicle Purchase Price. Give them one at the sale or they are coming back to you for it. Once your plates are off, the buyer may drive the vehicle for five calendar days without plates if they carry a dated, notarized bill of sale.

Does the title need a notary or witnesses?

A notary

47 O.S. § 1107(A): the holder of the certificate shall endorse a complete assignment with warranty of title on the back, with a statement of all liens, SWORN TO BEFORE A NOTARY PUBLIC or another person authorized to take acknowledgments, and deliver it to the buyer at the time the vehicle is delivered. § 1107(C) makes a violation a misdemeanor — up to $500 on a first conviction and $1,000 after, with the vehicle impounded until taxes and fees are paid. If your title is electronic, there is no paper title to sign. You use Form 718, Bill of Sale of an Electronic Title, in its place, and sign it before a notary.

What happens to the plates?

They come off, and stay yours

47 O.S. § 1112.2(A): the plate and registration are issued to and remain in the name of the owner, and plates are not transferable between owners. When the vehicle is sold the plate shall be removed and retained by the original plate owner. You may move it to a replacement vehicle of the same registration class for the remainder of the period, paying the difference if the new vehicle costs more to register.

Do you have to tell the state you sold it?

Pre-register within 2 business days (you or the buyer). The $10 notice is optional.

Pre-registration is required. Within two business days of the sale, either you or the buyer must pre-register the vehicle with Service Oklahoma. You and the buyer decide who submits it, online at Navigate. Separately, 47 O.S. § 1107.4: on transfer the seller MAY file a written notice with Service Oklahoma, and there is a $10 fee. What it buys is precise: after the transfer date shown on the records, the buyer is rebuttably presumed to be the owner and to carry the civil and criminal liability that ownership brings. And subsection D says plainly that not filing imposes no liability on you. So the $10 does not remove a penalty — it moves the presumption of ownership onto the buyer. The $10 notice has no deadline of its own. For pre-registration, business days are Monday to Friday, excluding state holidays.

Where does the odometer reading go?

2011 or newer: on a paper title, or on Form 729 with an electronic title

Service Oklahoma requires a completed odometer disclosure when transferring a vehicle from model year 2011 or newer, and states that the disclosure is generally built into the title's ownership assignment. Where the title does not carry it, Form 729 Odometer Disclosure Statement is required instead. If your title is electronic and you sell with Form 718, the form says an odometer statement goes with it for a vehicle newer than 2011.

Selling here, registering somewhere else

These are the rules where you are selling, not where the buyer is taking it. The title is signed under Oklahoma’s rules, and the plate and the notice are yours to handle here.

Registering it and paying tax falls under the buyer’s own state’s rules.

How Oklahoma compares

Counted from the same answers, for all fifty states.

See how Oklahoma compares with the other 49 states
  • Oklahoma is one of 7 states that want a notary on the seller’s title signature. The others are Kentucky, Louisiana, North Carolina, Ohio, Pennsylvania and Wyoming. The remaining 43 ask for neither.
  • In Oklahoma the plates do not go to the buyer. They stay with the vehicle in only 4 states — Alaska, California, Hawaii and Minnesota.
